The judgment of the Grand Chamber of the Court of Justice of the European Union of 1 October 2019 must be interpreted to mean that consent is not valid when the storage of information, or access to information already stored on the user's terminal through cookies, is authorized by a checkbox that is checked by default and that the user must uncheck to refuse. In this sense, authorization must be based on explicit consent through an explicit acceptance checkbox, a rejection checkbox by the user, and a more information checkbox for the cookies shown.
This interpretation cannot vary depending on whether the information stored or accessed on the user's terminal consists of personal data or not.
The Grand Chamber also states in this ruling that the information the service provider must provide to the website user must include the time the cookies will remain active and the possibility that third parties can access the information they store. This requirement is established by the version amended by Directive 2009/136, which modifies Article 5(3) of Directive 2002/58/EC, and by the AEPD Guide of July 2020.
